Academic activities in the country has been shut down for over seven months since the strike started.
The National Industrial Court of Nigeria (NICN) has ordered the Academic Staff Union of Universities to call off the strike and return to classes.
The Academic Staff Union of Universities has been on a persistent strike since February 14, 2022 over demands for improved funding of tertiary universities and reconstruction of the payments of the staff of the association.
After several months with no definite resolution between the Federal Government and ASUU, the case was taken to the NICN for a resolution.
In a judgement on Wednesday by the NICN, Justice Polycarp Hamman held that the strike was a breach of Section 18(1)(2) of the Trade Disputes Act, which prohibits their action.
According to Justice Hamman, the strike has caused irreparable damage to the careers of many students in Nigeria.
He also said that the use of “shall” in the Act connotes a mandatory provision not to embark on the strike pending the determination of the main suit before the court.
